1. Scope of services
I provide professional audio services including stereo mastering, Dolby Atmos and spatial mastering, Apple Digital Masters compliant deliveries, mixing and mix support on select projects, consulting, and related audio services. All work is handled personally and quoted per project.
2. Quotes and booking
Quotes are based on the material, scope, and deliverables. Quotes are valid for 30 days unless otherwise stated. A booking is confirmed only after written approval and, where applicable, receipt of a deposit. I reserve the right to decline projects at my discretion.
3. Files and deliveries
You are responsible for supplying correctly exported files, clear instructions, and any reference material. You confirm that you hold all necessary rights to the recordings and authorize the requested work. Final deliverables may include masters, stems, ADM files, or other agreed formats. Unless otherwise agreed, all deliveries are made digitally.
4. Revisions
Each project includes a reasonable number of small revisions intended to finalize the agreed direction. Major changes, alternate versions, remixing, or re-authoring Atmos assets may require additional fees, discussed in advance.
5. Fees and payment
Prices are quoted in CHF unless stated otherwise. A deposit may be required before work begins. Invoices are payable within 10 days. Late payments may incur reminder fees and interest in accordance with Swiss law. Files may be withheld until invoices are paid.
6. Credits and portfolio
Where appropriate, credit may appear as: “Mastering / Mixing: Martin Korth.” I may reference completed work in my portfolio, website, or professional channels, unless confidentiality is agreed in writing before release.
7. Intellectual property
You retain ownership of your recordings and compositions. I retain ownership of my processes, documentation, and session materials. Masters are licensed for the agreed usage once payment is complete.
8. Data protection
Personal data is collected only for communication, invoicing, and project handling. Data is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU GDPR. Data is not shared with third parties except when legally required or necessary for payments and file delivery.
9. Confidentiality
Unreleased material and project information are treated as confidential. This does not apply to information already publicly available or released by you.
10. Artistic judgment
Mastering and mixing involve subjective judgment. You acknowledge that results may vary depending on playback systems and environments.
11. Limitation of liability
To the maximum extent permitted under Swiss law, liability is limited to the amount paid for the service in question. I am not liable for indirect or consequential losses, including lost revenue or release delays. You are responsible for approving and backing up your files.
12. Cancellations and postponements
Work cancelled before it begins may incur administrative costs. Work cancelled after it has started is billed for time already spent. Postponed bookings may incur fees if notice is insufficient.
13. Force majeure
I am not responsible for non-performance caused by events beyond reasonable control, including technical failures, illness, or supply disruptions. Timelines may be adjusted as needed.
14. Website content
Content on martinkorth.com is provided for general information only and may change without notice. I am not responsible for third-party websites linked from this site.
15. Governing law and jurisdiction
These Terms are governed by Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland, subject to any mandatory statutory venues.
16. Changes to these Terms
I may update these Terms from time to time. The version published on the website at the moment of booking applies to the project.
